John Uustal, Catherine Darlson, and Michael Hersh Named “Most Effective Lawyers of 2020” by Daily Business Review

The report shared the case of tree trimmer Efrain Alamo-Cruz, who suffered permanent injuries when he fell 30 feet from a palm tree after his electric saw cut his safety harness. He suffered traumatic brain and orthopedic injuries, endures severe pain on a daily basis and is unable to work.
A lawsuit blaming his fall on company negligence was filed, then dropped. His new attorneys — John Uustal, Michael Hersh and Catherine Darlson — stepped in and found a way to move forward. The second lawsuit generated a default judgment against the tree-trimming company and a $23 million jury award in a damages-only trial.
With insurance coverage in play, the carrier litigated in federal court, and the attorneys became witnesses in an action to determine whether the insurance company was liable for payment. During the federal lawsuit, the carrier went to state court in an attempt to undo the award and attacking the case.
