The Kelley | Uustal team will work alongside the national food safety law firm of Ron Simon & Associates to file the first Boar’s Head Listeria Wrongful Death Lawsuit on behalf of the family of Gunter Morgenstein.
Gunter Morgenstein, an 88-year-old Holocaust survivor, purchased Boar’s Head liverwurst from a local store in Newport News, VA on June 30, 2024. Over the next few weeks, Morgenstein experienced weakness, shortness of breath and diarrhea. He was later hospitalized and diagnosed with sepsis and listeriosis that was eventually traced back to the Boar’s Head meat he consumed by the Center for Disease Control (CDC).
Morgenstein’s condition rapidly declined despite aggressive measures. He died on July 18, surrounded by loved ones.
His family filed the first wrongful death lawsuit in the ongoing Boar’s Head meats listeria outbreak, explaining that Morgenstein had purchased later-recalled Boar’s Head liverwurst, which resulted in his sudden illness and death.
According to the CDC, at least 57 victims across 18 states have tested positive for listeria poisoning from consuming contaminated Boar’s Head products. All victims have been hospitalized, and nine have died. This is the largest listeriosis outbreak since 2011.
An investigation by state health agencies identified several health violations at the company’s plant in Jarret, VA, including the presence of mold, blood puddles, old meat residue, and contaminated food surfaces.
Boar’s Head has since recalled all products manufactured at the plant, which remains closed until further notice.
