Florida Supreme Court: Celsius Must Pay Hip Hop Superstar Flo Rida

Fort Lauderdale, FL – The Florida Supreme Court has declined to review the Fourth District Court of Appeal’s decision finding Celsius Holdings, Inc. liable for breaching its endorsement agreement with Grammy-nominated artist Flo Rida.

The Supreme Court’s denial of certiorari cements a jury’s May 2021 finding that Celsius failed to honor its contractual obligations to Flo Rida by wrongfully withholding stock shares promised under their endorsement deal during the company’s explosive growth period. The decision marks a significant win for the artist and his legal team at Kelley | Uustal Trial Attorneys Trial Attorney.

Flo Rida played a pivotal role in promoting the energy drink brand and elevating its profile during a period of explosive growth for the company. Flo Rida filed a lawsuit against Celsius Holdings, alleging that the company violated the conditions of an endorsement deal. The rapper sought the stock shares promised to him under the agreement, asserting that he played a crucial role in the brand’s development and success.

“This case was never just about me. It was about standing up for artists and creators who put their reputation, hard work and vision behind brands. I just wanted what I worked for and what was agreed, nothing more, nothing less.” said artist Flo Rida.

The case will now return to the trial court solely to determine the appropriate valuation date for the shares wrongfully withheld. With interest, the judgement will either be approximately $55 million or almost $100 million, depending on which date the jury chooses.

Kelley | Uustal Trial Attorneys attorneys John Uustal and Cristina Pierson represented Flo Rida alongside co-counsel Jason Gonzales and Deepak Gupta.
