Kelley | Uustal Partner Todd Falzone and California-based Attorney Richard Alexander secured a $5 million wrongful death settlement for a father who lost his two children in 2021. The father sued Santa Clara County, alleging that Deputy Ryan Vesey’s high-speed pursuit—initiated on questionable grounds—led to their tragic deaths.
On that fatal night, Vesey claimed he attempted to stop a vehicle occupied by two young Hispanic males for allegedly failing to signal a lane change. The vehicle fled at high speed, reaching over 90 miles per hour before crashing into another car at a nearby intersection, killing two siblings as they made a lawful turn.
However, during the course of litigation, Falzone and Alexander uncovered critical dash cam footage showing the vehicle had, in fact, used its turn signal. Additional body cam footage revealed Vesey stating he “wanted to get something” that night, raising serious questions about his motives for initiating the stop due to the race and age of the occupants of the vehicle.
With this evidence, Falzone and Alexander argued that the attempted traffic stop was racially motivated and unjustified, ultimately leading to a deadly pursuit that never should have occurred.
Last week, the case reached a resolution with a $5 million settlement approved by the court, bringing long-overdue justice to a father devastated by the loss of his two children.
