As Miami-Dade County State Attorney prepares a grand jury investigation into the Surfside condo collapse, South Florida Business Journal Senior Reporter interviewed attorney John Uustal of Kelley | Uustal Trial Attorneys for insight.
Uustal said it’s extremely difficult to criminally indict an individual for the actions of a company or a condo association, assuming those actions reach the standard of criminal behavior. It would take a finding of a reckless action, where someone realized death could occur as a result of their actions, to bring criminal charges, he said. A negligent action is generally addressed with civil lawsuits, he added.
