“Sometimes the only way that you can affect change is by making a big impact. Maybe one person doesn’t have the power to change things on their own, but with the assistance of the justice system and a law firm willing to fight for them, they can really affect change,” — Cristina M. Pierson, Kelley | Uustal Partner.
Kelley | Uustal’s class action practice starts with the communities we know best. We have deep roots in South Florida, and build cases around harms affecting the people, businesses, and families here.
From there, we take on corporate wrongdoing at scale. When misconduct affects large groups of people, we bring the resources, strategy, and staying power to challenge powerful defendants, recover meaningful compensation, and push for change that reaches beyond any one case.
Often, companies count on consumers not reading the fine print, or not having the resources to fight back after being harmed by them in some way. They count on hidden fees blending into a bill, on marketing language stretching past what a product actually delivers, and on the assumption that no one will push back.
At Kelley | Uustal Trial Attorneys, we will push back. Accountability is not an abstract idea. It is a process. And the justice system is what gives an individual the power to pursue it.
“The people have taken back power against these big companies who seem to always want to rule our lives so they can make more money.” — John J. Uustal
With the right lawyer, one person can use that system to investigate what happened, compel evidence, put facts in front of a jury, and force a powerful defendant to answer for its conduct.
What the Product Label Was Not Disclosing: Drink LMNT Case
In July 2025, Cristina Pierson filed a class action lawsuit against Drink LMNT, Inc., alleging its electrolyte drink mix was marketed with claims like “No Artificial Ingredients,” “All Natural Ingredients,” and “No Dodgy Ingredients,” while the product allegedly contained 300 to 450 milligrams of maltodextrin per serving, a highly processed synthetic ingredient with a glycemic index higher than table sugar.
“The class action challenges the deceptive marketing and product descriptions that were misleading to consumers, who paid a hefty purchase price for what was presented to them as an all-natural product. Even since the recently forced confession by LMNT about the maltodextrin content, the company has failed to correct its marketing, which still deceptively portrays the products,” according to Pierson.
The case remains pending. Discovery in support of seeking class certification is underway.
Undisclosed Utility Fees: Greystar Case
Kelley | Uustal has filed a proposed consumer class action lawsuit against Greystar and River Landing Shops & Residences, alleging that tenants were charged recurring utility-related fees that were not disclosed or authorized in the property’s standard lease agreements.
As reported by Bloomberg, Miami surpassed NYC in cost of living for the first time in history. “Tenants trust that their lease spells out what they owe, and should not later be forced to comply with hidden fees,” said Pierson.
Corporate Negligence Shutting a City Down: Fort Lauderdale Water Break Case
In July 2019, a directional drilling operation near Fort Lauderdale Executive Airport struck a major water main, forcing more than 9,000 businesses to close and the surrounding area under restrictions for days. Cristina Pierson co-led the trial against Florida Communications Concepts, the contractor that proceeded to trial after other defendants, including Florida Power & Light, settled.
In December 2021, the jury returned its verdict, finding the contractor 98% responsible for the massive water main break. A final global settlement agreement, reached on behalf of thousands of affected businesses as part of a certified settlement class action, followed in May 2022 for $12,550,000.
